1. ABOUT THESE TERMS

This website and online store are operated by Arvell Private Limited under the trading name Babui Bird. These Terms of Service govern your access to babuibird.com and purchases made through the store. By using the website or placing an order, you agree to these Terms together with the Privacy Policy and the policies displayed on the website.

2. ELIGIBILITY AND ACCOUNTS

You must be legally capable of entering into a contract under applicable law. If you use the store on behalf of another person or organisation, you confirm that you have authority to do so. You are responsible for providing accurate account, contact, billing, and delivery information and for keeping account credentials secure.

3. PRODUCT INFORMATION

We aim to describe and display products accurately. Natural materials, screen settings, and handmade or production variations may result in reasonable differences in colour, grain, texture, dimensions, or appearance. Product-specific descriptions, care instructions, warnings, and eligibility information should be reviewed before purchase. Nothing on the website should be interpreted as an unverified safety, medical, or regulatory certification.

4. ORDERS AND AVAILABILITY

Submitting an order is an offer to purchase. An order is accepted when we confirm it and payment is successfully processed. We may decline or cancel an order where an item is unavailable, information is incorrect, payment cannot be verified, an obvious pricing or description error exists, or fraud or misuse is reasonably suspected. If we cancel a paid order, the amount received will be refunded to the original payment method.

5. PRICES, TAXES AND PAYMENT

Prices are displayed in Indian Rupees unless stated otherwise. The final amount, including applicable taxes and shipping charges, is shown at checkout before payment. Payment services are provided through Shopify and the payment providers available at checkout. You confirm that you are authorised to use the selected payment method.

6. SHIPPING AND DELIVERY

Processing times, delivery estimates, shipping charges, tracking, and delivery conditions are described in our Shipping Policy. Delivery dates are estimates unless expressly confirmed otherwise.

7. CANCELLATIONS, RETURNS AND REFUNDS

Cancellation requests are governed by our Cancellation Policy. Returns, exchanges, damaged items, and refunds are governed by our Return and Refund Policy. These policies form part of these Terms.

8. CUSTOMER COMMUNICATIONS

Transactional communications may be sent to complete an order, provide delivery updates, respond to support requests, protect the store, or meet legal obligations. Marketing communications are sent in accordance with consent choices and can be unsubscribed from using the method provided in the message.

9. ACCEPTABLE USE

You must not misuse the website, interfere with its security or operation, upload malicious code, scrape or copy protected content without permission, impersonate another person, submit false information, or use the store for unlawful or fraudulent activity.

10. INTELLECTUAL PROPERTY

The Babui Bird name, logo, website design, text, photographs, illustrations, graphics, and other original content are owned by or licensed to Arvell Private Limited unless stated otherwise. They may not be reproduced, distributed, modified, or used commercially without prior written permission.

11. THIRD-PARTY SERVICES AND SHOPIFY

The store is hosted by Shopify. Payments, delivery, analytics, communications, and other functions may be provided by authorised third parties. Their services may be subject to their own terms and privacy practices. Purchases from Babui Bird are transactions with Arvell Private Limited, not with Shopify.

12. PRIVACY

Personal information is handled in accordance with our Privacy Policy and applicable data-protection law. Privacy questions and requests may be sent to babuibird@arvell.in.

13. LIABILITY AND CONSUMER RIGHTS

Nothing in these Terms excludes or limits rights or remedies that cannot lawfully be excluded, including rights under applicable Indian consumer-protection law. To the extent permitted by law, we are not responsible for indirect losses that were not reasonably foreseeable or for delays caused by circumstances outside our reasonable control. Our responsibility for defective, damaged, or incorrectly supplied goods remains subject to applicable law and the Return and Refund Policy.

We may update these Terms to reflect changes in law, business practices, or the Services. The current version and its revision date will be posted on this page. Material changes will be communicated where required by law.

15. GOVERNING LAW

These Terms are governed by the laws of India. Courts and consumer dispute-resolution authorities with jurisdiction under applicable law may hear disputes. Nothing in this section restricts a consumer from using a forum or remedy available under applicable law.
